Protection Regulations for Registered Marks as an Embodiment of the Principles of the Rule of Law

Abstract

There are several classifications regarding brand counterfeiting, namely using the same brand as a whole, using the same mark in essence, using the same sign, using the same sign in essence with geographical indications. Apart from that, there is also counterfeiting of registered brands. However, registered trademarks must be protected by the State through trademark law. The problem is why the state needs to protect registered marks and the various forms of protection. The method used is normative, with a statutory and conceptual approach. This research shows that only registered brands receive legal protection. Because a registered mark is a mark that is legally registered at the Office of the Director General of Intellectual Property Rights, the form of protection for a registered mark is preventive protection and repressive protection.
