Dekonsentrasi: Paradoks dan Implikasinya Terhadap Kedudukan Gubernur Pada Era Otonomi Daerah

This research aims to investigate the position of the principle of deconcentration after the amendment of the 1945 Constitution and analyze its implications on the role of governors in the deconcentration function in autonomous regions. This study is a normative legal research with regulatory, conceptual, and legal history approaches. Secondary data were obtained through literature review. The 1945 Constitution does not explicitly formulate the principle of deconcentration for local government in Indonesia, resulting in the constitutional invalidity of the governor's position in the deconcentration function. Questions arise as to whether this constitutional vacuum can be justified by Law Number 23 of 2014 concerning Regional Government (Regional Government Law 2014). The research indicates that the deconcentration arrangement in Regional Government Law 2014 has undergone a shift, creating ambivalence regarding the governor's position in the era of regional autonomy. Although deconcentration is fundamentally a reasonable mechanism in the local government system, Regional Government Law 2014 alters the concept of deconcentration, endowing governors with a dual governance function. Governors are not only an extension of the central government in the region but also serve as the head of the region in autonomous areas. The study also highlights the potential application of the deconcentration principle to regents/mayors.
